Headnote | Service Law:Appointment – Whether by direct recruitment or by transfer –To the post of Higher Secondary School Teacher – Appellant wasappointed to the post by direct recruitment – Respondent No. 1 whowas working as Higher Secondary School Assistant in the School,filed a complaint questioning direct recruitment – She claimed thatthe post should have been filled up by her transfer – The complaintwas rejected by Deputy Director of Education – Departmentalappeal was dismissed by Director of Education – In Revision StateGovernment held that post was required to be filled up by transferof the respondent – Writ petition by appellant – Single Judge ofHigh Court relying on r. 5(3) of Kerala State and SubordinateServices Rules, 1958 held that vacancy was to be filled up on thebasis of cadre strength and not on the basis that first vacancy shouldbe filled up by transfer – In appeal Division Bench of High Courtsetting aside order of Single Judge held that r. 5(3) of 1958 Ruleswere not applicable and the post was to be filled up by transfer –On appeal, held: Appointment of teachers in the school wasgoverned by Kerala Education Rules, 1959 – Chapter XXXII of1959 Rules shall be followed for appointment – r. 5(3) of 1958Rules is not applicable – As per r. 4(2) of 1959 Rules the post wasfirst to be filled up by transfer – Therefore, Division Bench of HighCourt was right in directing appointment of respondent No. 1 –Kerala Education Rules, 1959 – Chapter XXXII, r. 4(2) – KeralaState and Subordinate Services Rules, 1958 – r. 5(3). |

National Digital Library of India (NDLI) is a virtual repository of learning resources which is not just a repository with search/browse facilities but provides a host of services for the learner community. It is sponsored and mentored by Ministry of Education, Government of India, through its National Mission on Education through Information and Communication Technology (NMEICT). Filtered and federated searching is employed to facilitate focused searching so that learners can find the right resource with least effort and in minimum time. NDLI provides user group-specific services such as Examination Preparatory for School and College students and job aspirants. Services for Researchers and general learners are also provided. NDLI is designed to hold content of any language and provides interface support for 10 most widely used Indian languages. It is built to provide support for all academic levels including researchers and life-long learners, all disciplines, all popular forms of access devices and differently-abled learners. It is designed to enable people to learn and prepare from best practices from all over the world and to facilitate researchers to perform inter-linked exploration from multiple sources. It is developed, operated and maintained from Indian Institute of Technology Kharagpur.
