Headnote | Judgment/Order – Reasoned Order – Family Court passed adecree of divorce by dissolving the marriage of appellant-husbandand respondent-wife – The Court also directed the appellant-husband to pay permanent alimony of Rs.15,00,000/- and litigationexpenses of Rs.10,000/- to the respondent-wife – Aggrieved withthe part of order which directed appellant to pay permanent alimony,appellant filed appeal before the Division Bench of the High Court,which was dismissed – Whether the Division Bench of the HighCourt was justified in dismissing the appellant’s appeal in limineand thereby upholding the order of the Family Court insofar as itrelated to awarding permanent alimony to the respondent-wife –Held: No – On perusal of the order of the Family Court and theHigh Court, it would show that both Courts failed to apply theirjudicial mind to the factual and legal controversy insofar as awardof permanent alimony to the respondent-wife is concerned – Boththe Courts did not even mention the factual narration of the caseset up by the parties on the question of award of permanent alimonyand without there being any discussion, appreciation, reasoningand categorical findings on the material issues such as, financialearning capacity of wife, a direction to pay Rs.15,00,000/- by wayof permanent alimony to the wife was given – Direction whollyunsustainable in law – Neither the Family Court nor the High Courtconsidered the legal principles applicable to the issues involvedand passed cryptic and unreasoned orders. |

National Digital Library of India (NDLI) is a virtual repository of learning resources which is not just a repository with search/browse facilities but provides a host of services for the learner community. It is sponsored and mentored by Ministry of Education, Government of India, through its National Mission on Education through Information and Communication Technology (NMEICT). Filtered and federated searching is employed to facilitate focused searching so that learners can find the right resource with least effort and in minimum time. NDLI provides user group-specific services such as Examination Preparatory for School and College students and job aspirants. Services for Researchers and general learners are also provided. NDLI is designed to hold content of any language and provides interface support for 10 most widely used Indian languages. It is built to provide support for all academic levels including researchers and life-long learners, all disciplines, all popular forms of access devices and differently-abled learners. It is designed to enable people to learn and prepare from best practices from all over the world and to facilitate researchers to perform inter-linked exploration from multiple sources. It is developed, operated and maintained from Indian Institute of Technology Kharagpur.
