Headnote | s.47 – Money decree – Execution proceedings – Both theparties filed their respective statements of calculations in regard tothe amount due under the decree of the Court – Executing Courtrejected the objections filed by respondent – Revision by respondent– High Court directed the appointment of Chartered Accountant toconsider the details of arrears – Held: High Court acted in manifestexcess of its jurisdiction while directing the appointment of aChartered Accountant for the purpose of determining as to whetherthe decretal debt is to be marked as satisfied – The executionproceeding is pending before the Civil Judge and various ordershave been passed thereon from time to time – The issue as to whetherthe decree has been discharged or satisfied has to be determinedby the Executing Court under s.47. CPC – The Executing Courtmust execute the decree as it stands, without adding anything to it –In the counter affidavit filed on behalf of the respondent, thecontention of the appellant that there was an admission in regard tothe balance of Rs 1.25 crores is sought to be controverted – Allthese are matters which must properly be addressed in the course ofthe execution proceedings – The High Court has acted in excess ofjurisdiction by directing the appointment of a Chartered Accountant,particularly at this stage – The impugned order of the High Court isset aside – Having regard to the fact that the dispute between theparties arose out of a contract of 1980 and an award of 1984 whichis still being executed, the High Court to dispose of the Civil Revisionexpeditiously. |

National Digital Library of India (NDLI) is a virtual repository of learning resources which is not just a repository with search/browse facilities but provides a host of services for the learner community. It is sponsored and mentored by Ministry of Education, Government of India, through its National Mission on Education through Information and Communication Technology (NMEICT). Filtered and federated searching is employed to facilitate focused searching so that learners can find the right resource with least effort and in minimum time. NDLI provides user group-specific services such as Examination Preparatory for School and College students and job aspirants. Services for Researchers and general learners are also provided. NDLI is designed to hold content of any language and provides interface support for 10 most widely used Indian languages. It is built to provide support for all academic levels including researchers and life-long learners, all disciplines, all popular forms of access devices and differently-abled learners. It is designed to enable people to learn and prepare from best practices from all over the world and to facilitate researchers to perform inter-linked exploration from multiple sources. It is developed, operated and maintained from Indian Institute of Technology Kharagpur.
