Headnote | Karnataka Land Reforms Act, 1961 – ss.44(1) and 107 –Private respondents filed suits against the appellant-University forinjunction restraining the University from interfering with theirpossession and enjoyment of the suit properties – Suits dismissedby the trial Court, however, allowed by the First Appellate Court –Appeals were filed before the High Court by the University – Duringthe pendency of the appeals, University filed writ peti tionchallenging the order dated 05.06.1981 passed by the Land Tribunalwhereby occupancy right had been granted in favour of the privaterespondents – Appeals as well as the writ petitions were dismissedby the High Court – On appeal, held: It is clear from the materialsplaced on record that originally the property in question belongedto the Maharaja of Mysore – He gifted the said property to thePresident of India – Thereafter, Union of India leased 22 acres ofsaid land for 99 years in favour of the University – Suit propertieswere a part and parcel of the said land – It is thus clear thatUniversity was the lessee of the said land – Further, the declarationregister maintained by the Land Tribunal does not contain any entryfor having filed declaration forms by the respondents – The Statehas also given the aforesaid particulars in their statement ofobjections – Respondents have not filed any rebuttal documents –It is clear that the order of the Land Tribunal filed was a fabricateddocument – Also, provisions ss.44(1) and 107 of the KLR Act makeit clear that any land belonging to or held on lease by a Universityestablished by law is not subject to the provisions of the KLR Act –High Court was not justified in holding that the private respondentsare in possession of the lands in question – They do not have titleor are in possession of the said lands – It is also clear that theUniversity is in lawful possession of the said lands – Further, HighCourt was not justified in dismissing the writ petitions filed by the University challenging the order of the Land Tribunal – The orderdated 05.06.1981 of the Land Tribunal is hereby quashed. |
