Abstract	RESUMO No contexto contemporâneo, a discussao nos foros regionais e mundiais sobre a protecao dos direitos dos individuos ganhou maior forca, a partir do momento em que os Estados nacionais aceitaram debater o assunto nao mais como questao exclusivamente interna. Isto alavancou o desenvolvimento normativo e institucional do Direito Internacional dos Direitos Humanos e do Direito Humanitario, ainda que em medidas diferentes, a um estagio inedito e elogiavel. A aplicacao das regras humanisticas na sociedade internacional mostra-se, contudo, ainda discriminatoria e seletiva, o que ressalta o carater peculiar do Direito Internacional, fortemente influenciado pelas Relacoes Internacionais e fundado no postulado da soberania dos Estados e nos principios dela decorrentes. Com isso, o objetivo do artigo e situar a complexa relacao que envolve os valores humanos no Direito Internacional, a partir de sua perspectiva westfaliana e realista-marxista que visa a contextualiza-los como produto de um processo historico inserido em um sistema interestatal, regido pela logica teoria da soberania e dinâmica pratica do realismo politico, o que difere diametralmente das estruturacoes juridicas internas dos Estados. ABSTRACT In the contemporary contexto, human rights discussion was fortified in the regional and global forum up to the moment that States accepted debating the issue as an international one. Such perception boosted normative and institutional enhancement of International Law of Human Rights and Humanitarian International Law, in different measures, to a remarkable and novel stage. The international praxis of human rights protection highlights, however, a discriminatory and selective action, which reveals the peculiar character of International Law. It suffers influence of International Relations and it is grounded over the postulate of State sovereignty and its derived principles. Therefore, this article aims at contextualizing the complex relation that involves human values in International Law up to a Westphalian and realist-marxist perspective, which understands human rights as a yield of a historical process, inserting in an interstate system and following State sovereignty principle and Realpolitics dynamic.
