Abstract	O tema aqui apresentado refere-se a compreensao dos direitos humanos nas relacoes do trabalho sob a otica do direito contemporâneo. Investiga a relacao entre o sistema laboral e sua praxis, mediado por uma justa realizacao no campo das relacoes laborais. O direito longe de ser reduzido a aplicacao de leis e codigos deve ser compreendido campo de manifestacao dos conflitos entre os homens, no resgate de seus direitos, tendo como parâmetro a justica. A pesquisa tem como opcao teorico-metodlogica uma abordagem critica do direito, elegendo como metodo de procedimento um estudo historico e comparativo. Conclui-se que o direito do trabalho, em sua feicao individual, e, sobretudo, na dimensao coletiva teve constituiu-se como fruto, tendo dessa forma o primado como consumacao das lutas sociais ao longo da odisseia dos trabalhadores no mundo do reino do poder do capital. FUNDAMENTAL HUMAN RIGHTS AND IN THE WORKPLACE FROM THE PERSPECTIVE OF CRITICAL THEORY The issue presented here refers to the understanding of human rights in labor relations from the perspective of modern law. Investigates the relationship between the system and his work practice, mediated by a correct implementation in the field of labor relation. The right distance to be reduced to the application of laws and codes must be understood as field of manifestation of conflict between men in the rescue of their right having the justice as a parameter. The research is theoretical and methodological option and a critical approach to the right, electing as a method of procedure and comparative historical study. We conclude that labor law in its individual feature and especially as a collective dimension hava established itself as the reason, and thus the primacy in the social struggles in the odyssey of workers throughout the world the power of the capital.
