| Abstract | The present study aims to demonstrate which are the vectors of normative regulation of the valuation of judicial evidence in the Code of Civil Procedure. The analysis starts from a pure concept of judicial evidence, including the interpretation of the legal provisions provided for in the Code of Civil Procedure, investigating the possibility of limitations to the assessment of evidence established in a procedural legal transactions, concluding that the parties can establish limits to judicial cognition and to the instructional powers of the judge. |
