| Abstract | The incipience of a constitutional environment after the Second World War led to the reinterpretation of all concepts and classifications of law. Despite the defense of an information theory consistent with the Contemporary State, one can not gloss over the historical construction that led to the current situation. In this way, we will treat the more classic procedural theories to then offer other paradigms of the study process with support in Constitution. The new constitutional order, which opened in 1988, advocating principles that govern the procedural norms and relations, determining how the process will be taken and their guarantees.
