| Abstract | This article has as theoretical framework the work coordinated by Ada Pellegrini Grinover and Kazuo Watanabe entitled "The Judicial Control of Public Policies" and was elaborated from theoretical-documentary research, with deductive technique and bibliographical, legislative, procedural and jurisprudential sources. The objective is to provide a reflection on the criticisms related to the Judiciary's role in granting the required measure, based on the analysis of concrete cases in which the Judiciary is activated by patients with serious diseases or by the Public Prosecution Service to seek the granting of medicines of high cost, whether or not they are included in the list of medicines approved by Anvisa. |
