Abstract	RESUMO: Este artigo trata da interferencia do Poder Judiciario no controle de politicas publicas de saude no fornecimento de medicamentos. Para tratar deste tema abordaremos na primeira parte a questao dos direitos sociais. Um dos aspectos mais relevantes e discussao sobre o direito ao minimo existencial e a proibicao do retrocesso. Em seguida, abordamos a questao das politicas publicas de saude dando enfoque ao controle exercido pelo judiciario e aos principios da separacao dos poderes e a reserva do possivel. E assim, finalizando com o tema, judicializacao do direito a saude no fornecimento de medicamentos e a efetividade do principio da supremacia do interesse publico, a fim de verificar se a atuacao do judiciario estaria protegendo o interesse coletivo ou agravando a situacao daqueles que necessitam da atuacao do Estado. ABSTRACT: This article deals with the interference of the judiciary in the control of public health policies in the supply of medicines. To address this issue we discuss in the first part of the question of social rights. One of the most important aspects is discussion about the right to a minimum existential kick and ban. Then, we address the issue of public health policies focusing the control exercised by the judiciary and the principles of separation of powers and possible reserves. And so, ending with the theme, legalization of the right to health in drug delivery and effectiveness of the principle of supremacy of public interest, in order to verify the performance of the judiciary was protecting the collective interest or worsening the situation of those in need of work State.
