| Abstract | Work monograph produced with the objective of demonstrating the doctrinal and jurisprudential disagreement about the interpretation and application of article 88 of the code of consumer protection, which expressly prohibits the use of the instrument of Sociedade simples of lide actions damage repair litigated by the consumer by an injury suffered as a result of the provision of service or supply of product with some sort of defect or addiction.
