Abstract Le présent chapitre examine les éléments particuliers à prendre en compte lorsqu'il s'agit de déterminer si les conditions convenues ou imposées dans des transactions entre entreprises associées qui font intervenir des biens incorporels sont conformes au principe de pleine concurrence. Il convient d'accorder une attention particulière aux transactions portant sur des biens incorporels, car celles-ci sont souvent difficiles à évaluer sur le plan fiscal. On étudiera l'application des méthodes appropriées fondées sur le principe de pleine concurrence pour la détermination des prix de transfert dans le cas de transactions portant sur des biens incorporels utilisés dans des activités commerciales, notamment de commercialisation. On étudiera aussi les problèmes spécifiques qui se posent lorsque les entreprises se livrant à des activités de commercialisation ne sont pas propriétaires de biens incorporels, tels que des marques et des noms commerciaux. Les accords conclus pour la répartition entre les entreprises associées des coûts afférents aux dépenses de recherche développement qui peuvent aboutir à la constitution d'actifs incorporels sont examinés au chapitre VIII.
