Headnote | Trade and Merchandise Marks Act, 1958 - ss. 46 and56 - Trade mark registered in favour of respondent no. 1 -Application of appellant for rectification of the registered Trade CMark - Dismissal of - On the ground of delay - Held: Onfacts, not justified - It prejudiced the rights of the appellant tohave the case adjudicated on merits - Appellant was pursuingits remedy with due diligence, without brooking any delay -There was not even a slightest delay on his part in challenging Dthe validity of the trade mark obtained by Respondent No. 1- It is a different matter that the application was returned bythe Delhi High Court for want of territorial jurisdiction -However, the moment it was so returned by the Registrar ofthe Delhi High Court, the appellant presented the same before Ethe Appellate Board (IPAB) on the same day - Having regardto all the facts, one fails to understand as to how IPAB coulddismiss the rectification on the ground that it was filed after adelay of 10 years - Appellant had pursued his remedy in abonafide manner and if it was filed in a wrong court and if he Fpursued his remedy wrongly by filing it in Delhi High Court,instead of Madras High Court, principles enshrined in s.14of the Limitation Act clearly get attracted - Matter remittedback to IPAB to decide the Rectification application on merits- Limitation Act, 1963 - s. 14. |

It is sponsored and mentored by Ministry of Education, Government of India, through its National Mission on Education through Information and Communication Technology (NMEICT). Filtered and federated searching is employed to facilitate focused searching so that learners can find the right resource with least effort and in minimum time. NDLI provides user group-specific services such as Examination Preparatory for School and College students and job aspirants. Services for Researchers and general learners are also provided. NDLI is designed to hold content of any language and provides interface support for 10 most widely used Indian languages. It is built to provide support for all academic levels including researchers and life-long learners, all disciplines, all popular forms of access devices and differently-abled learners. It is designed to enable people to learn and prepare from best practices from all over the world and to facilitate researchers to perform inter-linked exploration from multiple sources. It is developed, operated and maintained from Indian Institute of Technology Kharagpur.
