| Abstract | RESUMO: O presente artigo objetiva analisar a responsabilidade civil das instituicoes de ensino privadas pelos danos provocados aos alunos/vitimas de bullying no ambiente escolar, com supedâneo legal correlato. O estudo e descritivo-analitico, desenvolvido atraves de leituras e consultas a livros, entendimentos doutrinarios, artigos, legislacoes e jurisprudencias.O trabalho busca esclarecer que, apesar de acolher a responsabilidade subjetiva, consubstanciada pela teoria da culpa como regra geral na responsabilidade civil, o ordenamento juridico brasileiro tambem adotou a responsabilidade objetiva, ao incluir, no artigo 927 do Codigo Civil, a obrigacao de reparar baseada na atividade de risco desenvolvida pelo autor do dano. Sendo assim, sao necessarias apenas a existencia do nexo causal edo dano para que se verifique a responsabilidade da escola com relacao ao aluno vitima de bullying que estava sob sua guarda. Por fim, este estudo verificou que ha decisoes jurisprudenciais responsabilizando objetivamente as instituicoes de ensino por falharem ao prestar servicos educacionais sem seguranca, considerando os danos fisicos e morais causados aos educandos pelo ato de bullying . CIVIL LIABILITY OF PRIVATE EDUCATION INSTITUTIONS BULLYING IN CASES AMONG STUDENTS ABSTRACT: This article aims to examine the liability of private educational institutions for the damage caused to the students/bullied at school, with correlative cool footstool.The study is descriptive-analytical, developed through readings and consultations with books, doctrinal understandings, articles, legislation and case law. He sought to clarify that while welcoming the subjective responsibility, embodied by the theory of guilt, as a general rule in civil liability, our legal system has also adopted strict liability to include in article 927 of the Civil Code the obligation to compensate based on risk activity developed by the author of the damage. Therefore, it is necessary only the existence of the causal link and the damage for which there is the school's responsibility with respect to the student who was bullied in his charge. Finally, it was found that no court decisions objectively responsible educational institutions for failing to provide educational services without security, considering the physical and moral damage caused to students by bullying act.
