| Abstract | In this paper called "need to reform the Organic Code of Children and Adolescents, IN ORDER TO ENSURE ADEQUATE LEGAL AND SOCIAL PROTECTION OF CHILDREN AND ADOLESCENTS TO BE ADOPTED" I developed a doctrinal study and legal analysis regarding constitutional guarantees, in particular, which refers to the process that must become effective before a child or teenager into adoption, constitutional rights that are vested all Ecuadorians, not complied with international mandates, regarding adoption is violating the fundamental charter of Human Rights when the secondary rules, in this case the Code of Childhood and Adolescence, contains in its articulated adequate protection to vulnerable group enters a process of adoption. I developed an analysis of previous procedures for adoption; and the various rights that have been generated over time, according to the needs of society. Determined, as well as the law has evolved in the course of social generations. Separate chapter has earned the address within the doctrinal framework, the various levels and scope that has developed; Humanity as was overturned by so much suffering and horros of fratricidal wars, to declare some laws for its content became general or universal, starting from the standard beginning of humanity through the Old Law, Law Medieval, Modern Law, Contemporary, rules that emerged from the Pan American Congress, the Declaration of Geneva, Declaration of delhombre Rights, the Universal Declaration of Human Rights. He also developed a technical legal analysis of the evolution of the rights that protect humanity; so we, the Rights of the First, Second, Third and Fourth Generation, Legal Framework In the history of the origins and evolution right up to the contemporary law, its impact on the national and international level was determined. In the Legal Framework invoke the First Declaration of the Assembly of the United Nations, known as the Declaration of Geneva, Children's Rights, the Constitution of the Republic of Ecuador, in all these rules is shaped to systematic development of rights that protect man and within that vulnerable groups within which children and adolescents are. Stressed the procedural form is established in the current Code of Children and Adolescents. In order to provide more elements of analysis also developing a comparative analysis through comparative law, for which I have introduced in the analysis of the laws of the United States, Venezuelan law, the Peruvian standards, legislation brother country Colombia. |
