| Abstract | This thesis work entitled "NEED TO ENSURE THE INTEGRAL DEVELOPMENT AND INTERESTS PRINCIPLE OF THE RIGHTS OF CHILDREN AND TEENS THROUGH LEGAL REFORMS OF TENURE AS PROVIDED FOR IN THE CODE OF CHILDREN AND ADOLESCENTS" addresses the problems that are summarized in the following paragraphs. The Constitution of the Republic of Ecuador establishes the duty of the family to promote the integral development of children and adolescents, as the principle of the best interests of their rights, and ensuring the development of these children. In connection with these rights is the provision of Article 118 of the Code of Children and Adolescents, which provides that when the court considers appropriate for the development of the child or adolescent, entrust their care and upbringing of one of the parents, but this does alter the exercise of parental authority, this provision is insufficient because it limits the possibility of tenure is entrusted only to one parent, without considering that there may be situations such as the death of parents, abandonment by their children, migration of the father and mother, they involvement in illegal activities that undoubtedly situations necessitate that parenting and care is entrusted to persons other than, for example, grandparents , uncles, older brothers, among others, that will provide more favorable conditions for the development of the child and for the effective protection of their rights.
