| Abstract | espanolEn nuestros dias, es indiscutible que la tematica vinculada a la transhumancia transfronteriza en la region del Sahel se encuentra en el centro de todos los analisis sobre cooperacion transfronteriza y el desarrollo local en Africa. Esto explica sin duda la complejidad de esta cuestion habida cuenta de la amplitud de su ambito de aplicacion. En efecto, tratar de la trashumancia transfronteriza no es facil, por el contrario, se trata de una tarea dificil que requiere un enfoque muy metodico y un conocimiento considerable de las tematicas especificas al juridico pastoral en Africa. Por consiguiente, es logico plantearse la cuestion de saber cuales son los instrumentos juridicos existentes en materia de transhumancia transfronteriza en el Africa Occidental. ?Las organizaciones internacionales africanas garantizan los derechos a las comunidades pastorales? ?Cuales son los instrumentos, estatales y tambien asociativos, puestos en marcha por los paises de Africa Occidental a fin de mejorar la regulacion la transhumancia transfronteriza? Mi analisis se articulara asi pues en los contornos de la creciente reconocimiento del derecho de las comunidades pastorales por las instancias regionales africanas (I), asi como tambien en el analisis de los diferentes instrumentos juridicos que garantizaran el reconocimiento de los movimientos transhumantes a nivel local (II). EnglishIn our days, it is indisputable that the transhumance in cross-border Sahel countries is in the core of all the analyzes focused on the cross-border cooperation and local development in Africa. This explains without doubt all the complexity which envelope the hulling of such a topic in view of the vastness of its scope of application. In fact, dealing with the cross-border transhumance is not an easy thing, on the contrary, it is a delicate task which requires an approach very methodical, and considerable knowledge of specific thematic to cortex pastoral legal in Africa. Therefore it would be wise to ask the question of what are the existing legal instruments on the cross-border transhumance in West Africa? The African Union is protecting the rights to pastoral communities? What are the devices at the same time State but also associative put in place by the countries of West Africa in order to better regulate the cross-border transhumance? My analysis will focus therefore on the contours of the growing recognition of the right of pastoral communities by regional forums African (I). I am also interested in the analysis of different legal instruments guaranteeing the vitality of transhumants at local level (II) francaisDe nos jours, il est incontestable que la thematique liee a la transhumance transfrontaliere en zone sahelo saharienne se trouve au centre de toutes les analyses axees sur la cooperation transfrontaliere et le developpement local en Afrique. Cela explique sans nul doute toute la complexite qui enveloppe le decorticage d'un tel sujet compte tenu de l'immensite de son champ d'application. En effet, traiter de la transhumance transfrontaliere n'est pas chose aisee, bien au contraire il s'agit la d'une tâche delicate qui necessite une approche tres methodique, et une connaissance considerable des thematiques specifiques au cortex juridique pastoral en Afrique. Des lors il serait judicieux de se poser la question de savoir quels sont les instruments juridiques existant en matiere de transhumance transfrontaliere en Afrique de l'ouest? L'union Africaine garantie t-elle des droits aux communautes pastorales ? Quels sont les dispositifs a la fois Etatique mais aussi associatif mis en place par les pays ouest africains afin de mieux reglementer la transhumance transfrontaliere ? Mon analyse s'articulera2 ainsi donc sur les contours de la reconnaissance croissante du droit des communautes pastorales par les instances regionales Africaine (I). Je m'interesserai egalement a l'analyse des differents instruments juridiques garantissant l'epanouissement des eleveurs transhumants au niveau local (II) |
