| Abstract | O direito de peticao consagra aquela que e a mais antiga formula de participacao no exercicio do poder publico, e deu origem a um dos primeiros direitos fundamentais consagrados com o advento do constitucionalismo contemporâneo. Apesar disso, o seu desenvolvimento tem sofrido, ao longo dos ultimos seculos, diversas dificuldades, dando origem a diferentes intervencoes na pratica democratica actual. O presente trabalho pretende passar em revista essa evolucao, a fim de melhor enquadrar o regime europeu do direito – o qual sera analisado com maior pormenor. The right to petition is one of the oldest forms of political participation, and can be found among the the early fundamental rights. In spite of that, its evolution has been suffering several difficulties, and is in the origin of different types of interventions in modern democracies. This paper analyses the evolution of the righ to petition in order to explain the european regime, witch is explained in some detail.
