| Abstract | This paper assays, in a normative-teleological account, international human rights treaties ratified by Brazil regarding the specific purposes of the imprisonment system. One suggests an accommodation approach when analyzing the Criminal Code dispositions with the meaning of the treatment of offenders established in international norms which have had constitutional status taking into account each specific purpose. One stresses the importance of the judge of penal execution (corrections), to grant the observance of the right of individualization of punishment established in the Federal Constitution, mainly to avoid recidivism, protect society and improve justice. |
