| Abstract | The present work analyzes the European arrest warrant and the way in which the jurisprudence of the Court of Justice of the European Union has guaranteed the protection of the fundamental rights in the surrender procedures, due to the absence of possibility of refusal for violation of fundamental right. To do this, a brief analysis of the rules of the European arrest warrant will initially be carried out. The case law of the Court of Justice of the European Union on the subject will be examined, in particular the cases of Pal Aranyosi and Robert Căldăraru. |
