| Abstract | Stemming from a given sociopolitical context, the functions and limits of the general law of obligations and its general theory are hard to grasp in an absolute sense. Just barely translatable, because they are necessarily chiselled to fit fluctuating and plural political concepts, they do reveal themselves when studied in a more favourable light: that of the discourse of those who create, define and live in this context. Without purporting to combine the exhaustiveness and finesse generally required to analyze a discourse as rich and incisive as that of Justice LeBel, the authors nevertheless provide a general survey, in an attempt to outline his conception of the functions and limits of the general law of obligations. |
