| Abstract | This essay proposes the observation of the plural(istic) constitutive and constitutional components of the European Union, vis-a-vis its imperfect federalist complexion, noticed under traces of its judicial/juridical system which are demonstrated in accordance with the positive law, as in the decentralisation, vertical and horizontal division of shared powers, the supranational governance relativising boarders. It goes through the great freedoms and fundamental rights in order to study the construction of the postnational citizenship with support on the integrationist-community-unionist institutions, particularly the Legislative (parliaments) and access to justice. In addition, it uses the comparative method so that, equally, manages the analysis of the process of reaffirming the common identity as well as the formation of a citizenship in and of Mercosul, in the bases of the new Latin-American constitutionalism, open to regional integration. Not only, it arguments that those processes contribute to the persecution of the right of developing and the protection of public liberties, fundamental rights. All that assuming the inevitable context of politics and globalisation. In conclusion, it is attempted to create a constitutional-international theory of EU and Mercosul established upon the citizen as central agent and addressee of those projects; that demands the involved institutions recognize and dedicate their very first attention to the people, their direct beneficiary, heir and controller. |
