| Abstract | This article analyzes the evolution of ILO Convention 169, compared to Convention No. 107, within the human rights of indigenous peoples. After pointing out the context of globalization as an intensifying element of the intercultural conflicts between indigenous peoples and the State, economic groups and individuals, this article proposes, based on the theory of Boaventura Santos, the use of diatopic hermeneutics, within the scope of the interpretation of legal norms, with the purpose of reducing the complexity of our multicultural social reality and finding solutions through dialogue between internal and international norms and the use of conventionality control. |
