Headnote | Code of Criminal Procedure, 1973 – s.167(2) – Investigationnot complete within the period prescribed under – Right of anaccused in custody, to be released on bail – FIR registered againstappellants-accused– Appellants arrested and remanded to police/magisterial custody – Petition filed by the complainant praying forfair and impartial investigation– High Court passed order dtd.03.07.18 inter alia directing that investigation be conducted by agazetted police officer, not below the rank of AdditionalSuperintendent of Police (ASP)– On 05.07.18 charge-sheet filedby the police officer lower in rank than ASP– Magistrate returnedthe charge-sheet to the police for due compliance– Immediately afterthe expiry of 90 days, the appellants filed application for bail u/s.167(2) – Rejected– Held: In terms of s.167(2), the stage ofinvestigation ought to be confined to 90 or 60 days, as the casemay be– On the expiry of the period stipulated, an indefeasibleright accrues in favour of the accused for being released on bailon account of default by the investigating agency in completion ofthe investigation within the period stipulated – Since, the appellantswere in custody from 08.04.18, in terms of s.167(2) the investigationhad to be completed by 07.07.18 – However, in the present case, oncompletion of 90 days of prescribed period, there were no papersof investigation before the concerned Magistrate– Appellants werethus denied protection established by law– Appellants entitled tobail in terms of s.167(2).Code of Criminal Procedure, 1973 – s.167(2) – Period under,for investigation – If can be extended by the High Court – Held:Provisions of the Code do not empower anyone to extend the periodwithin which the investigation must be completed nor does it admitof any such eventuality. |

National Digital Library of India (NDLI) is a virtual repository of learning resources which is not just a repository with search/browse facilities but provides a host of services for the learner community. It is sponsored and mentored by Ministry of Education, Government of India, through its National Mission on Education through Information and Communication Technology (NMEICT). Filtered and federated searching is employed to facilitate focused searching so that learners can find the right resource with least effort and in minimum time. NDLI provides user group-specific services such as Examination Preparatory for School and College students and job aspirants. Services for Researchers and general learners are also provided. NDLI is designed to hold content of any language and provides interface support for 10 most widely used Indian languages. It is built to provide support for all academic levels including researchers and life-long learners, all disciplines, all popular forms of access devices and differently-abled learners. It is designed to enable people to learn and prepare from best practices from all over the world and to facilitate researchers to perform inter-linked exploration from multiple sources. It is developed, operated and maintained from Indian Institute of Technology Kharagpur.
