| Abstract | Der vorliegende Beitrag analysiert den Progressionsvorbehalt als besondere Tarifvorschrift bei Vorliegen bestimmter steuerfreier Einkünfte theoretisch und empirisch. Hierzu werden Anforderungen an einen systematischen Tarif entwickelt und auf den Progressionsvorbehalt übertragen. Hierbei erfolgt auch eine ökonomische Belastungsmessung von rechtlich steuerfreien Einkünften. Es zeigt sich, dass der negative Progressionsvorbehalt diesen Anforderungen nicht genügt. Vielmehr können Fälle so konstruiert werden, dass jeder beliebige positive Steuersatz (auch über 100 %) auf den steuerfreien oder den steuerpflichtigen Einkünften lastet. Zur Beurteilung des Ausmaßes von Tarifverwerfungen wird eine Maßzahl entwickelt, die verdeutlicht, dass der negative Progressionsvorbehalt über weite Einkommensintervalle die Anforderungen an ein systematisches Tarifgefüge nicht einhält.Eine empirische Auswertung des Steueraufkommens unter Durchführung einer Mikrosimulation belegt die gesamt- und einzelwirtschaftliche Bedeutung des Progressionsvorbehalts. So tragen zum größten Teil steuerfreie Sozialleistungen zum Gesamtaufkommen des Progressionsvorbehalts bei. Darüber hinaus kann empirisch belegt werden, dass die theoretisch ermittelten Verwerfungen auch in der Realität wiederzufinden sind.This paper analyzes the progression reservation (Progressionsvorbehalt) theoretically and empirically. At the beginning the historical development of the progression reservation is presented. Thereafter requirements on a systematic tax scale are defined and applied to the progression reservation. It turns out that the negative progression reservation does not meet these requirements, because marginal tax rates can occur over 100%. Moreover distortions are observed within a large range of the tax base.After this the paper presents a micro simulation on basis of individual tax statistics data from the Federal Statistical Office. As a result of this the theoretically analyzed distortions can also be found in reality. |

National Digital Library of India (NDLI) is a virtual repository of learning resources which is not just a repository with search/browse facilities but provides a host of services for the learner community. It is sponsored and mentored by Ministry of Education, Government of India, through its National Mission on Education through Information and Communication Technology (NMEICT). Filtered and federated searching is employed to facilitate focused searching so that learners can find the right resource with least effort and in minimum time. NDLI provides user group-specific services such as Examination Preparatory for School and College students and job aspirants. Services for Researchers and general learners are also provided. NDLI is designed to hold content of any language and provides interface support for 10 most widely used Indian languages. It is built to provide support for all academic levels including researchers and life-long learners, all disciplines, all popular forms of access devices and differently-abled learners. It is designed to enable people to learn and prepare from best practices from all over the world and to facilitate researchers to perform inter-linked exploration from multiple sources. It is developed, operated and maintained from Indian Institute of Technology Kharagpur.
