DOI: 10.12957/rqi.2016.21005 Resumo O presente artigo trata da constitucionalizacao do Direito do Trabalho no Brasil, para que se compreendam as razoes e os caminhos seguidos por este ramo do Direito, partindo da codificacao do Direito Civil, passando pelas origens do Direito do Trabalho ate sua constitucionalizacao, bem como dos desafios que essa trilha gera para avancos das relacoes trabalhistas. Assim, tem-se que o movimento de constitucionalizacao do Direito do Trabalho consagra os principios e valores do ordenamento juridico, em especial o da dignidade da pessoa humana, pois se preocupa com a valorizacao da pessoa do trabalhador, o qual deve ser protegido contra arbitrariedades do Estado e do empregador, de condicoes prejudiciais a sua saude e seguranca, entre outros aspectos ainda presentes no contexto da sociedade globalizada e multicultural. Para isso, atraves do metodo sistematico e da abordagem qualitativa, propoe-se investigar se o Direito do Trabalho, apos sua constitucionalizacao, tem possibilitado a superacao de conflitos intersubjetivos decorrentes do nao reconhecimento de dignidade do trabalhador, como ser humano detentor de direitos sociais. Palavras-chave: codificacao – Direito Civil - constitucionalizacao – Direito do Trabalho – dignidade Abstract This article deals with the constitutionalization of Labor Law in Brazil, in order to understand the reasons and the paths followed by this branch of law, starting from the Civil Law Code, through the origins of the Labor Law to its constitutionalisation, as well as challenges that this track generates for advances in labor relations. So has the constitutionalising movement of Labor Law enshrines the principles and values of the legal system, especially the dignity of the human person, as worries about the appreciation of the worker, who should be protected from arbitrariness the state and the employer of conditions harmful to their health and safety, among other things still present in the context of a globalized and multicultural society. For this, through the systematic method and qualitative approach, it is proposed to investigate whether the Labour Law, after its constitutionalization, has made it possible to overcome intersubjective conflicts resulting from non-worker dignity of recognition as a human being holder of social rights.
