| Abstract | A Directiva 2004/35/EC consagra uma definicao de dano ambiental e um regime juridico de responsabilidade ambiental baseado no principio do poluidor-pagador. Neste artigo a autora tenta fazer uma abordagem sistematica a este regime e uma avaliacao das primeiras decisoes dos Tribunais da Uniao nesta materia. Directive 2004/35/EC gave a definition of environmental damage and established a legal framework for environmental responsibility: based on the polluter-pays principle. In this article the author tries to make a systematic analysis of this regime and to make an evaluation of its first impact on the decisions of the EU courts.
