Abstract	DOI: 10.1590/2179-8966/2017/31488 Resumo O artigo analisa inicialmente a ambiguidade do processo de anistia e redemocratizacao do Brasil. Em seguida, o foco e o papel do judiciario tanto na judicializacao da repressao durante a ditadura quanto no processo de anistia. Na terceira secao e fornecida uma breve caracterizacao da ruptura institucional ocorrida no Brasil em 2016 e uma discussao sobre a natureza dessa ruptura. Por fim, em tom conclusivo, identificam-se relacoes entre os processos mencionados. Palavras-chave: Anistia; Justica de Transicao; Golpe de Estado; Poder Judiciario; Democracia; Brasil. Abstract The article initially analyzes the ambiguity of the amnesty and redemocratization process in Brazil. Next, the focus is on the role of the judiciary in both the judicialization of repression during the dictatorship and in the amnesty process. In the third section is provided a brief characterization of the institutional rupture occurred in Brazil in 2016 and a discussion about the nature of this rupture. Finally, in a concluding tone, we identify relationships between the mentioned processes. Keywords: Amnesty; Transitional Justice; Coup D'Etat; Judiciary; Democracy; Brazil.
