| Abstract | This article considers one of the main topics in the contemporary debate on legal philosophy, which is the place of reason in legal interpretation. The article studies the question of the objectivity and rationality of legal interpretation in the ideas of Owen Fiss, with a presentation of his thoughts on the adjudication and the notes of interpretation. It considers the four questions that are the central points of Fiss’ proposal: the rationality of interpretation, its objectivity, its correctness criteria, and the role of moral values. It finishes with a conclusive balance about the strongest and weakest aspects of Fiss’ ideas. |
