| Abstract | The independence of the Judicial Power is of material importance in every Rule of Law. The independence has an internal and external dimension. After 2011 by initiative of the Executive Power the Judiciary system in Ecuador was reformed. The concept of judicial inexcusable error was implemented for the first time with regards judges. Until present day this concept has not been regulated and allows the removal of a judge as a sanction. The application of this concept had as result the removal of multiple judges. The impact generated by the application of the judicial inexcusable error compromises the internal independence leaving the door open for interference and internal pressures on the judiciary. |
