| Abstract | Regarding civil liability derived form sports activities, although national doctrine has made a short approximation, Colombian jurisprudence has been shy about it, effort that may not be comparable with those made in other latitudes where they hold a broad amount of precedents regarding this topic. Whoever in an international approach, the assumption of risk doctrine has been profoundly applied in order to acknowledge when the sportsman assumes the damages generated by the activity and when they not. This work pretends to make a doctrinal approach to the fundamentals of civil liability and the aforementioned doctrine in order to proceed to evaluate how it was applied by foreign judges and determine weather it can be so applied under Colombian laws and how can be interpreted together with terms like gameplay, that have been already applied by foreign judges. |
