| Abstract | espanolEuropa ya no es una sociedad homogenea culturalmente. Algunas de las culturas, tradiciones o costumbres que traen consigo las personas que provienen de otros paises chocan con nuestra legislacion penal. En el trabajo me planteo hasta donde puede una sociedad democratica aceptar comportamientos que colisionan con valores, en algunos casos fundamentales, que la propia sociedad ha reconocido como suyos. Para ello parto de la consideracion de que hay algunos limites que no pueden traspasarse en aras del derecho a la cultura. A partir de ahi, estudio el posible encaje que las motivaciones culturales de un sujeto pueden tener en nuestro Derecho Penal. Adelanto que las soluciones que propongo afectan solo al ambito de la culpabilidad. EnglishEurope is no longer a culturally homogeneous society. Some of the cultures, traditions or customs that people have brought with them from other countries clash with our penal legislation. In this work I question just how far a democratic society can accept behaviours that clash with, in some cases, fundamental values, that the society has recognised as its own. For this reason I am starting from the consideration that there are some limits that cannot be crossed in the interest of the right to culture. From here, I study the possible niche that the cultural motivations of a subject may have in our Criminal Law. I bring forwards that the solutions that I propose only affect the sphere of guilt. |
