| Abstract | In the present investigation the right to the image of the professional football player is analyzed, for which national and foreign specialized bibliography has been consulted; and, the modification of article 7, inc. b) of Law N ° 26566: Labor regime of professional soccer players. Because of the wording of subsection b) it is understood that the sports club has unlimited right over the right to the image of the professional footballer. Aspect that we consider contrary to the constitutional and labor regulations, both destined to the protection of the human being because of their dignity. In this way, we want to protect the professional footballer from any illegitimate interference with his right to the image and ensure that all commercial use of his right is made through a transfer of rights, which must have the consent of the footballer as an essential element for its validity professional. |
