| Abstract | DOI: 10.1590/2179-8966/2017/28186 Resumo O artigo tematiza reparacoes as violacoes de direitos humanos dos povos indigenas na ditadura brasileira, no periodo de 1946 a 1988, lapso temporal da Lei da Anistia (Lei no 6.683, de 28 de agosto de 1979) e utilizada pela Comissao Nacional da Verdade. Pretende-se responder a seguinte pergunta: no contexto da Justica de Transicao, quais mecanismos de reparacao existem para os povos indigenas no Brasil? Neste paradoxo de (in)justica de transicao e medidas de reparacao para esta minoria surgem questoes relativas a quais medidas devem ser promovidas pelo Estado brasileiro, empresas privadas e/ou agentes militares. O objetivo desta pesquisa e tracar parâmetros adequados de reparacao aos povos indigenas no Brasil, por meio do direito a verdade, a memoria, a justica e ao territorio. Os resultados alcancados indicam que os mecanismos reparatorios para os povos indigenas sao frageis, ja que muitas limitacoes juridicas tem sido criadas para impossibilitar a promocao de uma justica de transicao indigena e em busca do direito a memoria, a justica, a verdade, a reparacao e ao territorio. Abstract The study thematizes reparations to human rights violations of the indigenous peoples that occurred during the Brazilian dictatorship, from 1946 to 1988, a period of time covered by the Amnesty Law (Law number 6.683). It was intended to answer the following question: before the transitional justice, what reparation mechanisms exist for the indigenous peoples in Brazil? In this context of transitional (in) justice and reparation for this minority, questions arise as to what measures should be taken by the Brazilian State, private companies and / or military agents. The objective of this research is to draw adequate parameters of reparation to the indigenous peoples in Brazil, through the right to truth, to memory, to justice and to territory. The results indicate that reparatory mechanisms for indigenous peoples are fragile, since many legal limitations have been created to make it impossible to promote an indigenous transitional justice system and seek the right to memory, justice, truth, reparation and to territory.
