| Abstract | This seeks to accomplish a critical analysis of the presidential veto of article 12B of PLC 07/2016, which would allow police officers to grant, on a temporarily basis, prior to judicial appreciation, protective measures of Law 11340/06, to women in situations of real risk of violence. It adopts the principle of primacy of the most favorable norm in order to ascertain its material [in]constitutionality. In the hiatus between judicial exclusiveness clause and the principle of women's human dignity, delay in granting protective measures to victims by the judiciary are not the exception, but the rule.
