| Abstract | The present investigation includes two topics of interest in people ́s daily life: the administrative silence and autonomy and decentralization issues. Both subjects are related, because the autonomous and/or the self-governing institutions are part of the Public Administration. The establishment of the administrative silence will require that in a determinate amount of time, the administration does not respond (in a positive or negative way) to any citizen request (citizen’s right) addressed to them, this fact produces an administrative neglect, which will end in the institution of the administrative silence. According with the State Modernization Law, the administrative silence will be set up in case that after a term of 15 days (business days), the public institutions have not respond yet to any kind of citizen request; however, the same law leaves open the chance for other laws to establish a different amount of time to implement the administrative silence. On the other hand, the Article 387 of the Ecuadorian Territorial Organization, Autonomy and Decentralization Organic Code founds that the administrative silence, in order to get established, there shall be passed a 30 days term (calendar days) without any response from one of the Autonomous Governments. Though, this Code lets the possibility to establish a different amount of time for each Local Government to configure the administrative silence.
