| Abstract | La Constitucion de la Republica de 2008, no obstante calificar al Ecuador como un Estado unitario, dota a los gobiernos autonomos descentralizados de una “facultad legislativa” que, a primera vista, haria pensar en la existencia de ordenamientos juridicos locales, de modo similar a lo que s컞 en un Estado federal. Esta aparente contradiccion merece un analisis sobre la naturaleza y alcance que tienen los instrumentos normativos que emiten los gobiernos autonomos descentralizados, sobre sus limites y contenidos y sobre la funcion que cumplen en el ordenamiento juridico de un Estado unitario como es el Ecuador. The Ecuadorian Constitution of 2008, although it proclaims that Ecuador is a unitary country, confers a “legislative attribution” to decentralized autonomous governments, which, at first sight, may lead to think that it is possible to affirm the existence of local juridical systems, similar to those existing in federal countries. This probable contradiction requires an analysis regarding the nature and scope of the regulations that are issued by decentralized autonomous governments, their limits and content, and the role they play within the juridical system of a unitary country such as Ecuador. |
