| Abstract | French Abstract: Cet article cerne les faiblesses de la Loi sur les services en francais et propose trois modifications principales de la loi qui pourraient ameliorer son efficacite et assurer la perennite des droits garantis par la loi. En premier lieu, les auteurs suggerent une clarification de la definition de l’expression « institution de la Legislature » afin de specifier la portee de la loi. Les auteurs proposent ensuite que la loi soit clarifiee a l’egard de la qualite d’agir du Commissaire aux services en francais ainsi que la juridiction des cours superieurs d’ordonner une reparation juste et appropriee en cas de violations de la loi. Finalement, les auteurs soutiennent que la loi devrait etre enchâssee dans la Constitution par la procedure de modification constitutionnelle etablie a l’alinea 43(b) de la Loi constitutionnelle de 1982. L’article recommande d’autant plus que la loi soit revisee periodiquement afin qu’elle puisse continuer de refleter le processus synergique de la protection du statut, des droits et des privileges de la langue francaise et des communautes de langue francaise en Ontario. English Abstract: This article identifies weaknesses of the French Language Services Act (hereafter, the Act) and proposes three main modifications of the Act that could better it’s efficiency and ensure the continuity of rights guaranteed by the Act. Firstly, the authors suggest a clarification of the meaning of the expression “institution of the Legislature” in order to specify scope of the Act. Secondly, the authors propose that the Act be clarified with respect to the French Language Service Commissioner’s legal standing, as well as to the jurisdiction of superior courts to to order just and appropriate remedial action for violations of the Act. Finally, they submit that the Act should be entrenched in the Constitution of Canada by the Constitutional modification procedure established at subsection 43(b) of the Constitutional Act of 1982. The article also recommends that the Act be reviewed periodically so that it may continue to reflect the synergistic processes of protection of the status, rights and privileges of the French language and French language communities in Ontario. |
