| Abstract | The Convention on the Rights of the Child is a good example of the evident tension expressed in most of international human rights treaties: on the one hand, they are aimed at securing a minimum standar of international protection on rights and freedoms for human beings; on the other hand, they allow the fragmentation and heterogenity of obligations engaged by States parties, specially by way of reservations, against such a standar. In this paper one analizes the complex problems relating to reservations in human rights treaties -presently under consideration by the International Law Commissionthrough the specific exam of the Convention on the Rights of the Child. One also defends the thesis of the objective control of reservation to be carried out by the organs created in human rights treaties no matter if the nature of such organs is or not judicial. |
