| Abstract | The present essay, developed in three parts, the first, analyzes the concept of person from the etymological scope and how it has managed to evolve over time. On the other hand, it describes the beginning of legal existence of the people in Ecuador and the beginning of biological existence of the human being; so that, from the compression of both aspects, reflect the status or legal status of the unborn. Subsequently, the concept of nasciturus is defined, it identifies the legal protection it has acquired at present and it is related to different international legal instruments. Likewise, mention is made of the protection of the nasciturus in Roman law; as well as, that which has been granted in the Ecuadorian legal system. In addition, a micro comparison is made between legal systems in which protection to the unborn is recognized and is a fundamental aspect. Finally, a description of the fetal therapies, how they arise in the medical plane, the types of fetal procedures that can be practiced in nasciturus, the kinds of pathologies or malformations that are susceptible of these medical procedures and the criteria under which can be realized. Finally, it is explained that in Ecuador the medical manipulations to those who are within the maternal womb are expressly prohibited; and that, therefore, fetal therapies will be denied by law. In this way, it is determined that when fetal interventions are prohibited, the right to life and integrity of the nasciturus as well as other related rights are clearly violated. |
