| Abstract | O artigo pretende demonstrar que sob o regime da Constituicao de 1988, em especial depois da alteracao do art. 241 promovido pela Emenda no 19/1998, foi revigorada a possibilidade de a prestacao dos servicos publicos ser feita mediante a associacao de entes estatais sob um regime juridico especifico e diferenciado, o qual poderia ser aplicado as concessoes relativas a prestacao do servico publico de energia eletrica (geracao, transmissao e distribuicao) que ora estao a iniciar a vencer e que foram outorgadas em favor de empresas estatais (federais e estaduais). The article intends to demonstrate that, pursuant to the legal framework of the 1988 Constitution, and especially after its article 241 was modified by Constitutional Amendment no 19/1998, the possibility that public services be rendered through an association between public entities, under a specific and particular legal regime, was reinvigorated. This legal regime could be applied to administrative concessions of energy services (generation, transmission and distribution) which are about to lapse and which were granted to public enterprises (federal and state-owned). |
