| Abstract | The Convention on the Rights of Persons with Disabilities is a real revolution in all spheres, particularly in the adaptation of domestic legislations. In Spain that adaptation has taken place in various areas, but not yet in civil law, which is probably the most important area, being that it is the body of regulation that treats the issue, including capacity of individuals, acting in the legal relationships and support means. Moreover, Spain’s Civil Code is a legal body supplementary to other laws. To the difficulties in reforming such a complex and important code we must add the big obstacle of communication between the civil legal establishment, including civil law authors, legal practitioners, the Law Coding Commission, and others, and the disability associations movement. To this so called civil dialogue we have to add the «Dialogue on Civil Law», which could possibly become a dialogued negotiated and consensual legal reform, without unnecessary conflicts. The purpose of this paper is to contribute to that aim. |
