| Abstract | La Ley Organica 5/2010, de 22 de junio, ha introducido en el Codigo penal espanol un nuevo delito que podria denominarse «falsedad en la inversion en los mercados de valores» (articulo 282 bis). Aqui se examinan sus elementos tipicos, analizando en que supuestos resulta aplicable, que situaciones concursales se plantean con otras figuras delictivas, y simultaneamente sugiriendo propuestas de reconfiguracion, con el objetivo de articular una adecuada proteccion del colectivo de inversores en el mercado de valores.A new offence that could be designated as «fake investments in the stock market» has been introduced, among others, by the Organic Law 5/2010 of June 22nd, under the article 282 bis of the Spanish Criminal Code. This paper intends to analyze the actus reus and mens rea elements of this offence and ascertain the situations that fall under its scope as well as the definition of its boundaries as it regards to other criminal offenses. Meanwhile, some ideas for a reform are also explained: the suggested changes aim at the proper protection of investor’s group within the stock market. |
