| Abstract | Penal law is a tool intended to regulate actions taken by members of a joint venture, mainly to prevent cases of violent attacks to the most relevant legal godos, such as life, personal completeness, sexual freedom and other life elements. Preventing legal and social negative actions t olive in a sound harmony is the core objective of the recently created juridicial instrument (COIP, 2014). In a doctrinarian fashions new special proceedings are used, in line to seriousness of goods and affected elements by one or various members of the joint venture. A direct procedure has been established as a structure to gather in one single hearing to obtain judgement of absolution, almost instantaneously. Currently an analysis has been made if due process warranty has been affected in such abbreviated process, and a certain number of practices shall be necessary to come to an explanatory determination. |
