| Abstract | espanolEl articulo aborda una reflexion en torno a la figura del sentido del fallo, la cual fue implementada en el articulo 373.5 del codigo general del proceso, establecida como una excepcion a la obligacion de los jueces de emitir sentencia una vez finalizada la audiencia de instruccion y juzgamiento. El calificativo de inane, referido al sentido del fallo, corresponde a una critica al desconocimiento de la complejidad de la decision judicial, y a sostener que cuando el juez puede emitir el sentido del fallo, de igual manera puede emitir la sentencia, a menos que existan dificultades de tipo locativo o de tiempo; por ende, y en los restantes eventos, si no puede emitir la sentencia, por desconocimiento de la decision que va a asumir, tampoco puede exigirsele que emita sentido del fallo. EnglishThis paper contains an analysis about the meaning of the decision, implemented with the article 373.5 of the General Procedural Code. That article established an exception to the duty to dictate the sentence, once the hearing of instruction and judging ends. This is a useless figure because implies a lack of knowledge of the complexity of the judicial decision, and it ignores that judges can give judgement when issue the meaning of the decision, unless difficulties of location or time arise. Thus in the remaining events, if the judge cannot issue the judgment due to ignorance of the decision, he cannot dictate the meaning of the decision either. |
