| Abstract | This study is an analysis applied to the Ecuadorian legal reality on the full exercise of the rights of participation of citizens in the context of social political activity of Ecuador and restrictions unconstitutionally are set in the text of the Comprehensive Organic Code criminal for exercise, which specifically focus enabled the development of this project in critical breach in its text carries the COIP (Organic Code Integral Penal), more specifically Article 68, in which a suspension sanction of rights is standard those who have been subjected to interference by the system of social rehabilitation for purposes of compliance with a conviction and the prohibition that this entails to exercise their rights of participation for a period greater than or additional time in one hundred percent of the established as a penalty for deprivation of liberty. It should then be noted, that the proposed analysis and in order to ensure a proper understanding of the subject, it has used the doctrinaire approaches developed by various writers in recent years, which has allowed objectively establish the parameters of legal infringement and constitutional attributable to the Ecuadorian legislator and detect in this regard, shortcomings whose remedy enable amend the drawbacks that the indicated provision entails for citizens and the social structure in general, since the deprivation of freedoms or subsuming rights to unconstitutional legislation undermines certainly stability of a political and legal organization. Moreover, it is essential need of this research clearly determine a conclusive framework to directly detect the main legal practical conditions that form the scaffolding of problem analysis and allow the reader to have elements of cause designed to facilitate the proposal of alternatives solution. |
