| Abstract | In this paper, we analyze the conflict between the positivist and postpositivist doctrines, according to the practice of the Brazilian judiciary. We underline that normative positivism does not present theoretical incompatibility with discretion of the judge and that the postpositivism approach has the purpose to assign limits and rationality to judicial decisions. Based on this assumption, this essay investigates how Brazilian doctrine and case-law absorbed the postpositivism theories. By analyzing the decision on homosexual marriage, it appears clear that the apparent conflict between positivism and postpositivism conceals the actual predominance of interpretive syncretism in the judicial reasoning. |
