| Abstract | The objective of this research is to establish whether remand prison as an alternative to securing the criminal process transgresses the principle of presumption of innocence, in the Puno jurisdiction, from 2015 to 2016 years. The research method is basic, because it bases the theoretical argument, which have been captured with by unit’s research, formed by the magistrates of the Puno judicial district, periods 2015 – 2016. The population was comprised of 285 judges, including: 197 prosecutors and 88 judges. We worked with 20% of all the magistrates working in the Judicial district Puno, using probabilistic sampling. The results, after the respective tabulation of the response given by the magistrates of the judicial district of Puno, confirms that, 91% of respondents consider that the pre-trial detention is not constitutional; 53% consider that the investigator having been declared innocent after a pre-trial detention, suffers detrimental and negative effects in the psychological and social field. 65 % of magistrates consider that the application of a preventive detention is incorrect; 78% of interviewees state that, the relationship between these two institutions in conflict is direct and somewhat striking; because 75% of the sample's members conclude that applying, the preventive detention is transgressing the presumption of innocence of the researched.
