| Abstract | This article is a general reflection, to analyze the protection of the constitutional right to the presumption of innocence, from the position taken by the criminal policy in Colombia position. In that sense, I study the different definitions given to the concept of criminal policy, which is to further identify the position taken by this kind of public policy in our country position. Against the constitutional right to the presumption of innocence, is analyzed from different notions, if this really is being protected by the position taken by the Colombian criminal political position, especially when abused in custody in prisons, for those who are being investigated by the commission of conduct punished by the criminal law. |
