Segundo essa visao, o direito de propriedade possui um carater objetivo e tem em si uma funcao social inseparavel. A concepcao moderna acerca do Direito e da propriedade promoveu uma modificacao naquele entendimento, causando a percepcao da propriedade como algo absoluto. O artigo conclui que o inconveniente causado por essa percepcao foi em parte mitigado pela construcao da nocao moderna de funcao social. Abstract The paper treats on the notion of property as understood by the Thomist Philosophy of Law. In this perspective, the right of property has an objective character and an inseparable social function in itself. The modern conception about the Law and the property promoted a modification on that view, causing the perception of the property as something absolute. The paper concludes that the inconvenient caused by this perception was in part reduced by the modern notion of the social function.
